1. Acceptance of Terms

By accessing or using Klevr WISP Engine ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Klevr WISP Engine is a software-as-a-service platform that helps tax professionals, CPAs, and accounting firms generate Written Information Security Plans (WISPs) aligned with FTC Safeguards Rule and IRS requirements.

Important Disclaimer: This tool provides templates and guidance and is not legal advice. You are responsible for consulting qualified legal counsel or compliance experts for final review and implementation of your WISP.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must immediately notify us of any unauthorized access or security breach.
  • You may not share your account with others or allow multiple users on a single-user license.

4. Subscriptions and Payments

One-Time Package

  • $299 one-time payment for a single WISP generation and export.
  • No refunds after document export.

Pro Plan ($49/month)

  • Billed monthly. Cancel anytime.
  • Single firm license with ongoing access.
  • Cancellation effective at the end of the current billing period.

Agency Plan ($149/month)

  • Billed monthly. Cancel anytime.
  • Supports up to 5 firms with white-label exports and team access.
  • Cancellation effective at the end of the current billing period.

All payments are processed securely through Stripe. We do not store your payment information.

5. Refund Policy

  • One-Time Package: No refunds after document export.
  • Monthly Subscriptions: You may cancel at any time, but no partial refunds are provided for the current billing period.
  • Refund requests for technical issues will be evaluated on a case-by-case basis.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or hack the Service
  • Share, resell, or redistribute generated templates without proper licensing
  • Upload malicious code or attempt to disrupt the Service
  • Violate any applicable laws or regulations

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by Klevr Consulting and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of the information you input. However, you grant us a license to use this information solely to provide the Service.

Generated Documents: You own the WISP documents you generate, but the underlying templates and technology remain our property.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind.
  • We do not guarantee that the Service will meet all regulatory requirements for your specific situation.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Klevr Consulting from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, you will lose access to the Service and any saved content.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Louisiana and the United States. Any disputes shall be resolved in the courts of St. Landry Parish, Louisiana.
